Initially, MVD suspends your driver license (DL) for 90 days, the first 30 days are an absolute suspension, and during the trailing 60 days you can apply for and receive a restricted license. You can delay this DL suspension by requesting a MVD hearing within 15 days of the issuance of the DUI citation. If you do not notify MVD that you are requesting a hearing within 15 days after the date of the DUI citation, your DL is automatically suspended for 90 days. The restricted DL is still available during the trailing 60 days within the 90-day period of suspension. This procedure is referred to as Admin Per Se. It is different from Implied Consent. If you refuse to cooperate with a law enforcement officer’s request for a BAC reading (blood, breath or urine), your DL will be automatically revoked by MVD for 12 months. If your DL is revoked for a violation of the Implied Consent statute, you will not be able to obtain a restricted DL for any reason.
In addition, upon conviction or plea of guilty for any DUI, the Court will notify MVD of the finding of guilt for a DUI, and MVD will suspend your DL for an additional 12 months. If you are ordered to install an ignition interlock device in your vehicle, then you will be able to obtain a Special Ignition Interlock Restricted Drivers License (SIIRDL) after you have had the ignition interlock device installed in your vehicle. You take the certificate issued by the ignition interlock installer to MVD, have MVD inspect your vehicle to determine if you have the ignition interlock device installed, and you can apply for the SIIRDL. It is good for 12 months, and it allows you to drive any vehicle (not just your vehicle) that is equipped with an ignition interlock device on any roadway in Arizona. However, it is a criminal citation if you are caught driving a vehicle without an ignition interlock device properly installed.
