The most common ways to beat a DUI citation are if the initial stop was performed without probable cause for the officer to stop your vehicle, and if the breath, blood, urine sample were taken or analyzed improperly (officer did not follow proper protocol). In addition, a DUI citation can be beaten if you have an independent witness (a passenger in your vehicle who is reasonably sober, or some other independent witness) who will testify convincingly in front of a jury that you were not too impaired to drive, that you were not driving the vehicle, or in some other significant way refutes the officer’s version of the stop or how you were driving erratically.
If you are involved in an accident, it is nearly impossible to beat the stop. If you are alone in your vehicle, your testimony will probably not convince a jury that the officer’s version of the incident is false or incorrect. And, unless your performance of the Field Sobriety Tests (FSTs) is filmed, you will not be able to refute the officer’s testimony that you failed all of the FSTs.
